Terms of Service

1. Acceptance of Terms

By accessing or using Belmore Cove ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

Belmore Cove reserves the right to modify these terms at any time. We will notify users of material changes via email or through the Platform. Your continued use after changes constitutes acceptance of the modified terms.

2. Platform Description

Belmore Cove is a marketplace platform that enables sellers ("Sellers") to create storefronts and sell food, crafts, handmade goods, and other products directly to buyers ("Buyers"). We provide the technology infrastructure to facilitate these transactions but are not a party to any transaction between Sellers and Buyers.

3. Seller Responsibilities

As a Seller on Belmore Cove, you agree to:

  • Permits and Licenses: Obtain and maintain all necessary business licenses, permits, and certifications required by your local, state, and federal authorities to sell your products.
  • Food Safety: If selling food products, comply with all applicable food safety regulations, including California Cottage Food Law (AB 626) or equivalent regulations in your jurisdiction. You are solely responsible for food safety, proper labeling, allergen disclosure, and handling.
  • Taxes: You are solely responsible for determining, collecting, and remitting all applicable sales taxes, income taxes, and any other taxes or fees required by local, state, and federal authorities. This applies regardless of the payment method used (including but not limited to cash, Venmo, CashApp, Zelle, or Stripe). Belmore Cove does not calculate, collect, or remit taxes on your behalf, and does not provide tax advice. You should consult a qualified tax professional regarding your obligations.
  • Accurate Items: Provide accurate descriptions, pricing, and availability information for all items.
  • Fulfillment: Fulfill orders in a timely manner as described in your storefront.

4. Buyer Responsibilities

As a Buyer on Belmore Cove, you agree to:

  • Provide accurate contact and payment information.
  • Be available to receive orders during agreed-upon pickup or delivery windows.
  • Review product descriptions, including allergen information, before purchasing.
  • Communicate directly with Sellers regarding any order issues.

5. Prohibited Items and Acceptable Use

Belmore Cove is committed to maintaining a safe, legal, and trustworthy marketplace. The following items and content are strictly prohibited:

  • Weapons and Explosives: Firearms, ammunition, explosives, fireworks, and weapons of any kind (including knives marketed as weapons).
  • Drugs and Controlled Substances: Illegal drugs, controlled substances, drug paraphernalia, and any substance regulated under federal or state law.
  • Alcohol and Tobacco: Alcoholic beverages, tobacco products, vaping supplies, and related accessories.
  • Adult Content: Pornography, sexually explicit material, adult services, or any content intended for mature audiences only.
  • Counterfeit and Stolen Goods: Counterfeit products, replicas marketed as genuine, and stolen property.
  • Intellectual Property Violations: Products that infringe on copyrights, trademarks, patents, or any other intellectual property rights.
  • Hazardous Materials: Chemicals, flammable substances, radioactive materials, and any items classified as hazardous under applicable regulations.
  • Live Animals: Live animals of any kind.
  • Human Remains: Human remains, body parts, or bodily fluids.
  • Hate and Violence: Items that promote hate, violence, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Unregulated Food Products: Raw meat, poultry, or seafood unless the Seller holds a valid license from the appropriate authority.
  • Anything Illegal: Any item or service prohibited by local, state, or federal law.

Sellers are responsible for ensuring that every item they list complies with all applicable local, state, and federal laws in their jurisdiction. If you are unsure whether an item is permitted, do not list it.

Belmore Cove reserves the right to remove any listing at any time and to suspend or permanently terminate accounts that violate these policies, without prior notice or refund.

If you encounter a listing that violates these policies, please report it at report@belmorecove.com or through our support page. We review all reports and take action promptly.

6. Acceptable Conduct

Beyond prohibited items, all users of Belmore Cove agree not to:

  • Use the Platform for any unlawful purpose or to solicit illegal activity.
  • Harass, abuse, or threaten other users.
  • Create fake accounts, impersonate another person, or misrepresent your identity.
  • Manipulate reviews, ratings, or any other feedback system.
  • Attempt to gain unauthorized access to the Platform or other users's accounts.
  • Use automated tools to scrape, crawl, or extract data from the Platform without our written consent.
  • Interfere with the Platform's operation, security, or performance.

7. Platform Fees

Belmore Cove offers two subscription tiers. Fees are subject to change with 30 days notice to active Sellers.

Free Plan: Sellers may operate 1 storefront. A 2.1% platform fee applies to each transaction processed through Stripe. Combined with Stripe's processing fees (approximately 2.9% + $0.30), the total per-transaction cost is approximately 5%.

Pro Plan ($9.99/month): Sellers may operate up to 10 storefronts with 0% platform fees. Only Stripe's standard processing fees apply. Pro includes access to analytics, prep lists, scheduled drops, loyalty programs, and other Pro features.

For transactions conducted outside of Stripe (e.g., cash, Venmo, CashApp, or other direct payment methods), no platform fees apply as Belmore Cove has no visibility into or involvement with those transactions.

8. Payment Processing

Belmore Cove is a storefront and order management platform. Sellers may accept payment through multiple methods, including Stripe (our integrated payment processor) and off-platform methods such as cash, Venmo, CashApp, Zelle, or other direct arrangements between Seller and Buyer.

Stripe Payments: For transactions processed through Stripe, you agree to Stripe's Terms of Service. Belmore Cove does not store full credit card information. Funds are typically transferred to Seller accounts within 2-7 business days after a completed transaction.

Off-Platform Payments: For transactions conducted outside of Stripe, Belmore Cove serves solely as a storefront and ordering tool. We have no visibility into, control over, or responsibility for whether payment is actually exchanged, the amount exchanged, or the method used. All off-platform payment disputes are strictly between the Buyer and Seller. Belmore Cove bears no liability for off-platform transactions.

9. Account Termination

Belmore Cove reserves the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, receive multiple complaints from Buyers, or fail to respond to platform communications. We may terminate accounts at our sole discretion with or without notice.

10. Dispute Resolution

Disputes between Buyers and Sellers should first be resolved directly between the parties. If a resolution cannot be reached, you may contact Belmore Cove at support@belmorecove.com for mediation assistance. Belmore Cove's decision in any dispute shall be final and binding.

11. Your Content

By uploading photos, descriptions, or other content to Belmore Cove, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on our platform. You retain ownership of your content. You can remove your content at any time by deleting items or your storefront. When you delete content, we remove it from public display within 24 hours.

You represent that you own or have the right to use any content you upload, and that it does not infringe on anyone else's rights.

12. Content Moderation

User-generated content on Belmore Cove, including storefront descriptions, product listings, photos, and any other material uploaded by users, is the sole responsibility of the user who created it. Belmore Cove does not endorse, verify, or guarantee the accuracy of any user-generated content.

We reserve the right to review, edit, remove, or restrict any content on the Platform at our sole discretion, including content that we determine violates these Terms, our policies, or applicable law, or that we find objectionable for any reason.

Buyers and other users can report content they believe violates our policies by contacting us at report@belmorecove.com or through our support page. We take all reports seriously and will investigate promptly.

While we strive to address reports quickly, Belmore Cove is not obligated to monitor all content proactively and cannot guarantee that all violations will be detected or addressed immediately.

13. Copyright and Intellectual Property

If you believe content on Belmore Cove infringes your copyright, contact us at report@belmorecove.com with:

  • A description of the copyrighted work
  • The URL of the infringing content
  • Your contact information
  • A statement that you have a good faith belief the use is not authorized

We will review and remove infringing content promptly.

14. Platform Role and Section 230

Belmore Cove is a technology platform that connects Sellers and Buyers. We are not a party to any transaction between users. We do not manufacture, store, inspect, or sell any products listed on the Platform.

Under Section 230 of the Communications Decency Act, Belmore Cove is not the publisher or speaker of any content provided by users. While we may moderate content in good faith, this does not create an obligation to review all content or make us liable for content we do not remove.

Sellers are independent operators, not employees, agents, or contractors of Belmore Cove. We make no representations or warranties about the quality, safety, or legality of items listed, the accuracy of listings, or the ability of Sellers to complete transactions.

15. Limitation of Liability

BELMORE COVE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELMORE COVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

Belmore Cove is not responsible for the quality, safety, legality, or availability of any products sold on the Platform. We are not liable for any foodborne illness, allergic reactions, or other harm resulting from products purchased through the Platform.

16. Indemnification

You agree to indemnify and hold harmless Belmore Cove, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action arising from these terms shall be brought exclusively in the state or federal courts located in the State of Delaware.

18. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated to users via email or through the Platform at least 30 days before taking effect. Your continued use of the Platform after changes constitutes acceptance of the modified terms.
